1. Acknowledgment of Risks

I, the undersigned participant (“Participant”), acknowledge that participation in step aerobics classes, fitness training, or any physical activity offered by iStep Fitness LLC (“iStep Fitness,” “we,” “our,” or “us”) involves inherent risks. These include, but are not limited to, slips, falls, muscle strains, sprains, cardiovascular complications, accidents, or other injuries that may result in physical or emotional harm.

I understand that these risks cannot be entirely eliminated without jeopardizing the essential qualities of the activity. I voluntarily choose to participate in these activities and assume full responsibility for all associated risks, whether caused by my own actions, the actions of others, or the condition of the premises, equipment, or facilities.

2. Health and Medical Condition

I certify that I am physically fit to participate safely in physical exercise and that I have consulted a physician regarding any medical conditions that could affect my participation.

I agree to immediately inform iStep Fitness staff of any injury, dizziness, or discomfort experienced during participation. I understand that iStep Fitness staff are not medical professionals and that no employee or instructor can diagnose or treat any health condition.

3. Assumption of Risk and Release of Liability

In consideration of being permitted to participate in step aerobics classes, training sessions, or related activities at iStep Fitness LLC, I hereby:

Assume all risks, known and unknown, associated with participation in any iStep Fitness activity;
Release, waive, and forever discharge iStep Fitness LLC, its owners, officers, employees, instructors, and contractors from any and all liability, claims, demands, actions, or causes of action for injury, illness, death, or property damage arising out of or related to participation in these activities; and
Agree not to sue iStep Fitness LLC or any of its representatives for any injury or damages that may occur, whether caused by negligence or otherwise.

This release extends to all acts of negligence by iStep Fitness LLC or its employees to the fullest extent permitted by law.

4. Indemnification

I agree to indemnify and hold harmless iStep Fitness LLC, its owners, employees, and affiliates from any loss, liability, damage, or cost (including legal fees) they may incur as a result of my participation in activities or my presence on the premises.

5. Photography and Media Release (Optional)

I grant permission to iStep Fitness LLC to take and use photographs, videos, or other media of me participating in classes or events for promotional or educational purposes, without compensation.
If I do not wish to be photographed or recorded, I will notify staff in writing prior to participation.

6. Emergency Medical Treatment

I consent to receive emergency medical treatment if needed while participating in activities at iStep Fitness LLC. I understand that all medical costs incurred are my responsibility and not the responsibility of iStep Fitness LLC or its staff.

7. Governing Law

This Waiver and Release shall be governed by and construed in accordance with the laws of the State of Florida, and any disputes shall be resolved exclusively in the courts of Broward County, Florida.

8. Severability

If any portion of this document is held invalid, the remaining provisions shall continue in full legal force and effect.

9. Electronic Acknowledgment (For Online Use)

By checking the acknowledgment box or clicking “I Agree” during online booking or registration, I acknowledge that I have read, understood, and voluntarily agree to this Waiver and Release of Liability.
I understand that my electronic acceptance constitutes a legally binding signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable Florida law.
